A questão faz pensar - e muito o que dizer. A primeira consideração, que assoma, é política. Quais os limites da jurisdição?

Figuremos a hipótese, referente a um contrato de plano de saúde:
(a) uma cobertura não é contratada,
(b) nem consta do rol mínimo
(c) fixado pela ANS
(d) após amplos estudos.
Caberá ao Poder Judiciário, ex post facto, preencher esse - aparente - vácuo?
